General Public Information & Motorist Guidance: This procedure guide is an independent citizen educational reference compiled from the Motor Vehicles Act 1988, Central Motor Vehicles Rules (CMVR) 1989, and published transport gazettes. Official government filings, statutory fee payments, and smart card dispatches are handled directly via parivahan.gov.in.

1. Executive Overview & Statutory Background

Vehicle ownership transfer is the legally mandated process under Sections 49 and 50 of the Motor Vehicles Act 1988 whereby the legal title of a registered motor vehicle is formally transferred from the current owner to a new purchaser. Failing to transfer the RC leaves the previous owner legally and financially accountable for any traffic violations, challans, accidents, or criminal liabilities involving the vehicle.

Under the regulatory architecture framed by the Ministry of Road Transport and Highways (MoRTH), all state registering authorities operate through the centralized Vahan 4.0 database engine managed by the National Informatics Centre (NIC). This system guarantees that every vehicular transaction is logged into a unified, cryptographically secure ledger visible across national police, transport, and insurance networks.

Statutory Rule Reference

Form 29 (Notice of Transfer) β€’ Form 30 (Application for Transfer) β€’ Form 31 (Transfer on Death) β€’ Form 32 (Public Auction)

Eligibility Criteria

Any individual or entity who has purchased a pre-owned vehicle, inherited a vehicle following the demise of the registered owner, or acquired a vehicle through a court or bank public auction is eligible and legally obliged to apply for RC transfer.

2. Step-by-Step Procedure (Online & Offline)

Follow this sequential procedure to ensure zero rejection by the Motor Vehicle Inspector (MVI):

1

Obtain & Execute Forms 29 and 30

Both seller and buyer must sign Form 29 in duplicate and Form 30. Take a clear chassis number pencil stencil print on Form 30.

2

Apply on Parivahan Sewa Portal

Visit parivahan.gov.in > Online Services > Vehicle Related Services. Enter vehicle registration number, select "Transfer of Ownership", authenticate via OTP sent to Aadhaar-linked mobile.

3

Upload Mandatory Documents & Pay Fee

Upload scanned copies of original RC, insurance, PUC, buyer ID, and signed forms. Pay government transfer fee through payment gateway and print receipt.

4

Physical Inspection or Biometric Verification

In states supporting contactless faceless RTO (like Delhi, Maharashtra), Aadhaar e-KYC is sufficient. In other states, submit physical file at the jurisdictional RTO.

5

Approval and Smart Card RC Dispatch

Motor Vehicle Inspector (MVI) verifies documents. Once approved, the new smart card RC is printed and dispatched via Indian Speed Post to buyer’s registered address.

3. Mandatory Documents Checklist

Every applicant must assemble the following documentation before visiting the RTO or completing digital file upload:

  • Original Registration Certificate (RC Book / Smart Card)
  • Form 29 (Notice of Transfer) in duplicate, signed by seller & buyer
  • Form 30 (Application for Transfer) with chassis pencil imprint
  • Valid Pollution Under Control (PUC) Certificate
  • Valid Motor Vehicle Insurance Certificate
  • Buyer’s Address Proof (Aadhaar, Voter ID, Passport, or Electricity Bill)
  • Buyer’s PAN Card or Form 60
  • No Objection Certificate (NOC / Form 28) if moving across RTO boundaries
  • Passport-sized photographs of buyer and seller

4. State-Specific Variations & Local RTO Rules

While the Central Motor Vehicles Rules (CMVR) prescribe standard forms nationwide, states such as Maharashtra, Delhi, Karnataka, and Tamil Nadu mandate specific local road tax re-assessments or local municipal clearance certificates.

5. Statutory Penalties & Late Fees

Failure to register the transfer within the statutory time limit triggers compound interest on late registration fees and can result in impounding of vehicle under Section 39 of MV Act.

6. Electronic Record Validity (DigiLocker / mParivahan)

Through the MoRTH Vahan 4.0 centralized database, citizen-centric online ownership transfer allows digital document upload, Aadhaar authentication, and instant digital acknowledgment tracking.
